Web Hosting Terms

This policy represents the Dzain Terms of Service (“TOS”) for Hosting in its entirety and supersedes any other written or oral policy. This policy defines the terms of service all customers agree to when they sign-up for hosting services with Dzain. Dzain reserves the exclusive right to revise, change or amend any portion of this Policy at any time, without advance notification to customers.

Customers using any services offered by Dzain consent to be bound by and must comply with all policies in this TOS. At the sole discretion of Dzain. Any violators of this TOS may have their services canceled without refund and/or, if deemed appropriate, be legally prosecuted.

General Provisions
In consideration for Dzain maintaining one or more accounts (each “Account”), you agree to the following terms of service.


  • “We” “Us” or “Provider” Dzain.
  • Dzain (Dzain F.Z.E) – a company registered in Ajman, United Arab Emirates, under company number 32115 with our registered office address as 01818, Building AFZ B1 Ajman Freezone, United Arab Emirates, UAE.
  • “You” “Your” “Client” “Customer” or “Member.”
    Each person or entity who applies for internet service or is a designate of any one who applies for internet service.

Disclaimer of Warranty
The Internet is a complex network of equipment, services and providers of information, thus the Service may not be available to you at all times. However, Dzain offers a 99.9% uptime guarantee. This is valid for only the connection. Dzain will pursue all resources and channels available to maintain maximum uptime, however, Dzain is not responsible for any down time caused by client’s error. DZAIN MAKES NO EXPRESS OR IMPLIED WARRANTIES (INCLUDING BUT NOT LIMITED TO WARRANTIES OF NON-INFRINGEMENT, MERCHANTIBILITY OR FITNESS FOR A PARTICULAR USE) WITH RESPECT TO THE SERVICES IT PROVIDES. Neither Dzain nor any one else involved in the provision of Service is liable to you or any third-party for direct or indirect damages resulting from the use, non-use of services provided herein, whether or not such damages resulted from the negligence of Dzain, even if Dzain has been advised to the possibility of such damages.

Services provided by Dzain
Dzain will provide Internet server rental (“the Service”) to its members for the express purpose of allowing customers to provide http Internet content to the general public. The Service allows Dzain members to maintain Internet websites, receive and maintain e-mail accounts and access web space via Cpanel and FTP to upload files for their websites. Dzain members will use the provided services in a manner consistent with any and all applicable laws of the United Arab Emirates Law. Dzain provides the Services exclusively and makes no effort to edit, control, monitor or restrict the content of data other than as necessary to provide such Services. Dzain reserves the right to refuse customers from utilization of its services, without notification. If any of the below activities are committed, Dzain can terminate client’s account without notification.

    1. Client Content: Client agrees that webpages and files uploaded to servers will not violate any province, federal or foreign laws or regulations; infringe on any intellectual property rights of Dzain or any third party; be defamatory, slanderous or trade libelous; be threatening or harassing; be discriminatory based on gender, race, age; promote hate; or contain viruses or other computer programming defects which result in damage to Dzain or any third party. Customers may not run IRC, bots or clients.
      Unacceptable uses also include: Bulk unsolicited emailing, unsolicited emailings, newsgroup spamming, child porn or links to such sites, cgi/php proxy scripts, copyrighted MP3, storing personal backups, illegal content, copyright infringement, trademark infringement, warez, cracks, software serial numbers. Dzain will be the sole and final arbiter as to what constitutes a violation of this policy.

    2. Bandwidth Usage: Dzain offers a generous amount of data transfer per month. This rule only comes into play when you use excess server processing power that negatively impacts the performance of the server and provides a bad customer experience in that server community. Minimizing the impact on an individual servers processing power is key to the overall performance of that server. In the vast majority of cases, if you use the web hosting service appropriately, visitors to your website will be able to view, download, and add as much content from your site as they wish. However, in certain circumstances, our server processing power, server memory, or anti-abuse controls could limit downloads or access from your site. Violators to the above rule will not be tolerated. You can upload all the content that you require each month subject to the rules as outlined above.

    3. Excessive Resource User Policy: Resources are defined as bandwidth, memory and/or processor utilization. A website is considered using “Excessive amounts of resources” when it monopolies the resources available using 10% or more of system resources for longer than 60 seconds. There are numerous problems that could cause such problems, this includes but not limited to: cgi scripts, FTP, HTTP, etc. A site that consumes over the account limit of bandwidth is also considered “excessive resources”. This policy is only implemented in extreme circumstances and is intended to prevent the misuse of our servers. The client whom is using “excessive resources” will be asked to upgrade his/her package to one of our Cloud Server or dedicated server packages. Dzain will be the sole and final arbiter as to what constitutes a violation of this policy. Suspensions will only occur if client violates above restrictions.

    4. No “Spam”: UCE/UBE or “Spam” originating from a server located on our network or associated with a Dzain server is not tolerated.  Client shall not use their Dzain services for chain letters, junk mail, bulk-email, or any use of distribution lists to any person who has not given specific permission to be included in such a process. Dzain reserves the right to deactivate or terminate any account(s) upon any indication of such activity without notice.

    5. Email usage limit: Client agrees not to exceed the limit of 100 outgoing emails per hour per hosting package and not to exceed 5 failed or deferred mail per hour to maintain the quality of outgoing email and to ensure that clients emails will be in the inboxes of their receivers. Any account sent over this limit will be considered as spam and will have their account suspended automatically. 
      Dzain does not limit incoming email, client can receive many email without limit.

    6. False Information: Client agrees not to post false or inaccurate information to news groups in violation of the news groups’ rules and regulations. If any news groups or service provider contact Dzain concerning unethical, false or unlawful activities by you, Dzain reserve the right to terminate your service without notice.

    7. Licensed Software Only: Client agrees to use only properly licensed third party software in connection with Client’s use of the Services. We do NOT allow any type of NULLED software. Customers using any nulled scripts/plugins/themes or related software will have their account suspended immediately. The accounts will not be reinstated unless fully destroyed and re-created with the customer consenting to only use legitimate software with appropriate licenses.

    8. Back-Up Files: Dzain offers a Premium Backup Service to all of our customers. The backup service can be purchased as an addon service to any active hosting account. It is the responsibility of the customer to keep up-to-date archives of their backed up data. Customers can use FTP, cPanel and PHPMyAdmin to make their own backups at any given time. Dzain is not responsible for any lost data.

    9. Domain Names: When you first register a new domain, ICANN requires all registrars to verify your contact details. You will receive an email from us requesting you to review and verify these details. Failure to do so will eventually lead to the suspension of your domain. This suspension is enforced by ICANN and is not the responsibility of the hosting provider. Should your domain be suspended, your website and email account will be taken offline until the issue is resolved. Once a domain has been suspended you will need to click the link in the original email they sent in order for the domain to come back online. If you need the email to be resent please open a support ticket and we will be happy to resend it.

    10. Shared Hosting: Shared hosting plans cannnot act as a reseller, which means that clients may not host any websites in their Addon Domains that are not domains owned by the client on file at Dzain. You will need to have a Reseller Hosting plan. Content on a shared hosting plan should be under the administrative authority of the account holder.

Payment, Renewal, Cancellations

  1. Payment Obligations: Full payment is required in advance before hosting service is established. Dzain sends out invoices that are due every pay period. You are given fifteen (15) days to fully pay the invoice. You warrant and represent that the information you supply in the Order Form (or other information that Dzain may require) is accurate and truthful. All payment-due notices will be sent by e-mail. No bills or invoices will be sent by postal mail or fax. If payment was not received by the due-date, your account will be suspended and possibly sent to collections. To have your account re-established, you will need to pay the full fees, plus any late fee’s. All fees mentioned are in AED funds. All overdue account with more than 15 days will be terminated without notice. Dzain may terminate all overdue account before 15th days.

  2. Renewals: Your account will be automatically renewed under the same billing cycle unless you give written notice to Dzain thirty (30) days before the renewal date that you do not wish to renew or make changes to such account. Once a renewal payment has been processed and paid there are absolutely no refunds issued. Coupons and promotions are available to New Customers only and apply to the ‘Initial Term’. All web hosting plans renew at our regular rates.

  3. Cancellation & Refunds: Should you become unsatisfied with our services within the first 15 days of your account activation (new customers only), Dzain will refund your hosting fee subject to the money back guarantee terms listed in this agreement. Refunds are not available for all accounts after the 15 days of account activation which includes renewing your services. You may however cancel your account at any time but no refunds will be issued. You will need to contact customer service 30 days before your renewal date and verify information before cancellation takes place. You will be charged in full for the entire month in which you canceled your account. Accounts which have negative balances will be sent to collections and all services will be terminated, including domain registrations. Customers wishing to switch their FREE domain to another registrar or cancel their service are subject to a AED100 domain release fee.

    Refunds are never available for domain registrations, control panel licenses (cPanel,…) setup fees, account addons, renewals of any services or dedicated servers.

Refunds are NOT given for any account upgrades or add-ons, only the hosting portion is refunded in full. There are no exceptions and no refund(s) will be awarded for upgrades at any point after your first 15 days of initial signup.

If you’ve purchased web hosting services from Dzain in the past and signed up again you are not eligible for the 15 day money back guarantee. The 15 day money back guarantee is strictly for new customers purchasing services for the first time. Existing customers who purchase additional hosting plans are NOT eligible for the 15 day money back guarantee. The 30 day money back is only for new customers that have never used our services.

99.9% Service Level Agreement “SLA”
Dzain offers its clients a 99.9% network uptime guarantee for customer satisfaction purposes and also to ensure that your business is running problem free. Dzain will try to maintain maximum uptime. Dzain is not responsible for any downtime caused by the client.

Support / Assitance
The hosting plan provides fundamental technical support, which covers the configuration of control panel elements (CPANEL) excluding external email configuration (Outlook,…), email autoresponders, external DNS configurations and all others external services (API,…). Technical issues related to the hosting service will be resolved with our technical teams if they are not attributable to the user or their actions. However, assistance with configuring or utilizing additional services is not included.

Third Party Script Assistance
Dzain retains the right not to assist clients with third party applications. This includes any script uploaded by the client, installed using cPanel, it’s scripts library or any installer within. Any assistance, support, or troubleshooting provided by Dzain for ANY third party script or application will be subject to a service fee.

15-Day Money Back Guarantee and Domain Registrations
Dzain offers an 15-day money back guarantee that covers cancellations of a shared web hosting account made during the first 15 days of service, due to the inability to deliver satisfactory services. As a part of our strive to achieve industry leading customer satisfaction, the customer will be refunded all hosting charges made to their credit card minus any setup fees which are non-refundable. The guarantee does not apply to accounts with non-use, misuse, and/or abuse of this agreement. Domain name registrations, setup fees , Server Cloud & Dedicated server fees are also non-refundable. Refunds are NOT given for upgrades at any point in time after the first 15 days of being an active client.

Fair Use & Equal Share Policy

Dzain customers now have access to unlimited disk space, bandwidth and data transfer. Essentially then, you can use whatever disk space and bandwidth is necessary for your web hosting needs.

What is acceptable and appropriate usage?
Dzain web hosting is continually investing in technology and support features. Our web hosting solution has specifically been designed to serve the web hosting needs of small and independently owned and operated businesses and organizations throughout the world. Since you will be hosting your website with hundreds of others on our servers in a virtual community, our offerings ( or any shared web hosting) are really not intended to support enterprise level or large company requirements. For that, we recommend purchasing at least a virtual private server or dedicated server solution.

Dzain web hosting is a shared web hosting service, which ultimately means a number of customers’ websites are hosted within the same server environment. To ensure that our hosting is first-class, reliable, and available to all customers within that server community, an individual customer’s website usage cannot adversely affect the performance of other customers’ sites. We monitor our servers 24/7/365 and in no way can one customer adversely affect the performance of that server. If this happens, we will take preventative measures to ensure that the entire community is protected.

Lastly, our web hosting service is intended to host websites, not backup or storage facility for users’ data. Using your web hosting account primarily as an online storage space for archiving electronic files and images is strictly prohibited. Our servers are for web hosting usage only. If you use your hosting space for Backups or FTP data storage we will delete the files/folders without prior notice as this is strictly prohibited. This includes using the server as a cloud storage service or a file sharing platform. This is strictly prohibited.

What is unlimited?

  • Unlimited disk space:
    You can create a website as large as you like, hundreds or thousands of web pages; you will not be penalized for exceeding any upper or ceiling limit. However, please realize that there are many other users on your server and growing a website very large too fast will impede the performance of that server, as using too many server resources will negatively impact other customers on that server. We will place some constraints on how fast you can grow that website and monitor the server resources closely. The vast majority of our customers’ sites grow at rates well within our rules, however, and will not be impacted.

  • Video & Media disk space:
    For customers hosting media content such as videos, music files or image content we allow a maximum media storage allocation of 50GB on our shared hosting plans. This limit is in place only on our shared servers to ensure equal share of the servers disk space. You can host unlimited websites however the disk space for media files should not exceed 50GB in total. We monitor disk usage and will contact customers if they hit this limit to offer alternative hosting solutions. This same limitation applies to customers storing Cloud data.

  • Unlimited bandwidth and data transfer:
    This rule only comes into play when you use excess server processing power that negatively impacts the performance of the server and provides a bad customer experience in that server community. Minimizing the impact on an individual server’s processing power is key to the overall performance that server. In the vast majority of cases, if you use the web hosting service appropriately, visitors to your website will be able to view, download, and add as much content from your site as they wish. However, in certain circumstances, our server processing power, server memory, or anti-abuse controls could limit downloads or access from your site. Violators to the above rule will not be tolerated. You can upload all the content that you require each month subject to the rules as outlined above.

  • Unlimited Email:
    You can create an unlimited number of email addresses. Each email cannot exceed 25GB and in total email account maximum at 150GB on our shared hosting plans. This is a combines total for ALL email addresses inside your cPanel hosting account. On our VPS and dedicated servers there are no restrictions as your limitations would be based on the plan you choose.
